RESOLUTION NO. 25958
RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA, STATE OF CALIFORNIA, SUPPORTING EQUAL PROTECTION FOR CIVIL MARRIAGE AND OPPOSING FEDERAL CONSTITUTIONAL AMENDMENT PROHIBITING SAME-SEX CIVIL MARRIAGES

WHEREAS, the City of Santa Rosa has by policy and ordinance stated its commitment to fair and equal treatment of all persons regardless of race, gender or sexual orientation; and

WHEREAS, in 2000 the City of Santa Rosa established a policy of providing equal benefits to domestic partners; and

WHEREAS, both the United States Constitution and the State of California Constitution provide that no person within its jurisdiction shall be denied equal protection of the laws; and

WHEREAS, a civil marriage contract is completely separate and distinct from any religious, ethnic or other tradition, ceremony, or belief regarding marriage; and

WHEREAS, denying civil marriage deprives couples of numerous state and federal rights, privileges, immunities, protections and responsibilities; and

WHEREAS, no citizen of Santa Rosa, or employee of the City of Santa Rosa, should be denied equal protection under the law.

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Santa Rosa urges the courts and legislature of California, based upon the equal protection clauses of the state and federal constitutions, to legalize same-sex civil marriages and calls for the courts to strike down any law that abridges the right of same-sex couples to enter into civil marriages.

BE IT FURTHER RESOLVED that the Council opposes any amendment to the United States Constitution that would restrict or ban same-sex civil marriages.
