RESOLUTION NO. 2008-202
A RESOLUTION REQUIRING THAT ALL NEW CONSTRUCTION OF CITY BUILDINGS, IN EXCESS OF 5,000 SQUARE FEET, MEET LEED CERTIFICATION AT THE SILVER LEVEL, UNLESS A WAIVER IS GRANTED.

WHEREAS, the City of Kent desires to encourage new development to include sustainable design and building practices; and

WHEREAS, the City desires to support the standards for construction of buildings that are environmentally responsible, energy efficient, healthy for employees; and will attract business to the City; and

WHEREAS, the City understands that circumstances may occur making compliance with this requirement cost prohibitive or unreasonable, and will allow a waiver with proper documentation.

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Kent, Portage County, Ohio, at least a majority (5) of all members elected thereto concurring:

SECTION 1. That all new construction of buildings owned or occupied by the city of Kent, Ohio that are 5,000 square feet of floor area or greater shall be certified to the U.S. Green Building Council’s LEED Silver Level.

SECTION 2. That requirements of LEED certification may be waived in an emergency situation, or under documented circumstances where compliance would be cost prohibitive, create an unreasonable burden on the project, or have a negative impact on a historic structure.

SECTION 3. That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Council and that all deliberations of this Council, and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements of Section 121.22 of the Ohio Revised Code.

SECTION 4. That this Resolution shall take effect and be in force from and after the earliest date allowed by law.
