METHANE COGENERATION FACILITY
Request is made for approval of the following resolution affirming the Board’s intent to act as “Lead Agency” during the coordinated environmental review of the proposed methane/natural gas cogeneration facility:

WHEREAS, the Board of Trustees of Hudson Valley Community College has passed a Resolution authorizing the College to investigate and consider the feasibility of developing an alternative source of energy for the College by utilizing methane gas generated by the neighboring City of Troy Landfill and transforming it to electrical power through the use of a cogeneration facility (the “Project”); and

WHEREAS, following the circulation of a Request for Proposal, the receipt of responses, and meetings with responders, the College determined to work with Siemens Building Technologies, Inc. to determine whether the Project is technologically, and economically feasible, and, based upon investigations by the staff of the College and information provided by Siemens, the College wishes to now consider the impact this facility may have on the environment; and

WHEREAS, pursuant to Article 8 of the Environmental Conservation Law, Chapter 43-B of the Consolidated Laws of New York, as amended (the “SEQR Act”), and the regulations adopted pursuant thereto by the Department of Environmental Conservation of the State of New York, being 6 NYCRR Part 617, as amended (the “Regulations”), the College has preliminarily determined that this Project falls within the classification of an Unlisted Action and desires to undertake a “coordinated review” (as said quoted term is defined in the Regulations) in order to determine whether the Project would have a significant effect on the environment;

WHEREAS, in furtherance of this “coordinated review”, on December 6, 2002, the College, as the Project Sponsor, prepared and submitted to each and every “Involved Agency” (as said quoted term is defined in the Regulations) an environmental assessment form (the “EAF”) and notice that the College, through its Board of Trustees, desired to act as “Lead Agency” during the environmental review of this Project; and

WHEREAS, each Involved Agency has thirty (30) days from the date of the December 6, 2002 notice to object or otherwise consent to Hudson Valley Community College, through its Board of Trustees, acting as “Lead Agency”; it is therefore

RESOLVED, that the Board, on behalf of the College, affirms its intent to act as “Lead Agency” in connection with the environmental review of the Project; and be it further

RESOLVED, that absent any objection from the Involved Agencies duly notified by the College of its intent to seek such status, Hudson Valley Community College, through its Board of Trustees, shall become the “Lead Agency” as of January 6, 2003; and be it further

RESOLVED, that the College, its staff and representatives, are hereby directed to proceed in whatever manner necessary to solicit and obtain all information that will be helpful to the Board in determining the significance of any environmental impact in connection with this Project.
